Terms of Service
These terms govern your use of rubyy.com and any Rubyy services that link to this page, including our SMS messaging programme. By using the site or services, you agree to these terms. If you do not agree, please do not use the site.
1. What Rubyy is
Rubyy is a self-serve event ticketing platform for event organisers and ticket buyers. While we are in coming-soon mode, the site offers a launch-list email signup, a contact form, and a cookie-consent banner. The full ticketing product is in active development; if you have been invited to a private preview you will have received separate instructions and credentials.
2. Eligibility
You must be at least 13 years old to use rubyy.com. If you are between 13 and the age of majority in your jurisdiction, you must have parental or guardian consent. Some Rubyy services (purchasing tickets, registering as an organiser, receiving SMS) may require a higher minimum age in specific jurisdictions; we will surface those at the point of signup when they apply.
3. Acceptable use
Do not use the site to do anything illegal, to send spam, to attempt to break our security or rate-limits, to impersonate someone else, or to scrape content at scale. We reserve the right to block IP addresses, sessions, or email addresses that abuse the forms or other endpoints. The defensive measures already in place (rate-limiting, CSRF protection, bot detection, the cookie-consent audit log) are described in our Privacy Policy.
4. SMS messaging programme
This section governs the Rubyy SMS messaging programme once you opt in by verifying your phone number or by ticking the SMS opt-in box at checkout. It applies in addition to the rest of these Terms.
4.1 What messages we send
SMS messages from Rubyy are strictly transactional. We do not send marketing or promotional SMS. Categories you may receive after opting in:
- Account security — one-time login verification codes and two-factor authentication codes.
- Order confirmations — a single confirmation when a ticket order is completed, with a link to view the tickets.
- Event reminders — a reminder ~24 hours before an event you have tickets to, with a link to the tickets.
- Order pickup notifications — when your order is ready for pickup at a will-call window.
- Cashless wristband alerts — low-balance notifications and top-up confirmations for events that use the Rubyy cashless wristband system.
4.2 Opt-in
You opt in to the Rubyy SMS programme by either (a) adding and verifying your mobile phone number through your Rubyy account settings, or (b) ticking the SMS notifications opt-in box at checkout when placing a ticket order. Opt-in is express, voluntary, and limited to the message categories above. Verifying your phone number for security-code purposes does not automatically opt you in to non-security categories; you can manage each category from your Rubyy notification preferences.
Opting in is optional and is not a condition of purchasing tickets or using Rubyy.
4.3 Opt-out
To stop all messages from Rubyy, reply STOP (also recognised: STOPALL, UNSUBSCRIBE, CANCEL) to any message we send you. We will send one final confirmation and you will not receive any further messages from the Rubyy SMS programme. To re-enable messages after opting out, reply START (also recognised: UNSTOP, YES) or re-enable SMS in your Rubyy account settings.
4.4 Help
Reply HELP (also INFO) to any message to receive Rubyy support contact details. You can also email [email protected] for help with SMS or any other Rubyy service.
4.5 Frequency, carriers, and costs
Message frequency depends on your activity (number of orders, events attended, and which alert categories you have enabled). Typical volume is 0–6 messages per event you attend, capped at 3 messages per day per recipient excluding security codes. Message and data rates may apply depending on your wireless carrier and plan. The Rubyy SMS programme is supported on most US carriers, including AT&T, T-Mobile, Verizon, US Cellular, Sprint, Boost, Cricket, MetroPCS, and Virgin Mobile — coverage on other carriers, prepaid plans, and international networks varies. Carriers are not liable for delayed or undelivered messages.
4.6 Privacy
Your phone number is used only to deliver the messages described above. We do not sell, rent, or share your phone number with third parties for their own marketing. The third-party SMS providers we use to route messages (currently Twilio and, in some regions, Telnyx) act as data processors and are bound by their own privacy commitments. Full details of how we handle personal data are in our Privacy Policy.
5. Accounts and credentials
If you create a Rubyy account, you are responsible for keeping your password and any two-factor secrets confidential. Tell us at [email protected] as soon as you suspect unauthorised access. We may suspend an account that is being used to abuse the platform.
6. Intellectual property
The Rubyy name, logo, gem motif, site content, and code are owned by Rubyy. You may not copy, modify, or redistribute them without our written permission, except for normal browser-level use (saving a page, printing for personal reference, sharing a link).
7. Disclaimer of warranties
The site and services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or virus-free, or that any specific message will be delivered on time or at all.
8. Limitation of liability
To the maximum extent permitted by law, Rubyy and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the site or services. Our total liability for any claim arising out of these terms is capped at the amount you paid us in the 12 months preceding the claim, or USD 100, whichever is greater.
9. Indemnity
You agree to indemnify and hold Rubyy harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these terms or your misuse of the site or services.
10. Termination
You can stop using the site at any time. We can suspend or terminate access for users who violate these terms, abuse the services, or where we are required to by law. Terms that by their nature should survive termination (intellectual property, limitation of liability, indemnity, governing law) will survive.
11. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You and Rubyy agree that the state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising out of or relating to these terms, subject to any mandatory consumer-protection laws of your country of residence.
12. Changes to these terms
If we materially change these terms, we will update the "last updated" date above and, where appropriate, notify launch-list subscribers by email. Continued use of the site or services after a change takes effect means you accept the updated terms.
13. Contact
Questions about these terms? Email [email protected].
14. Telephone (voice) communications
Rubyy operates a customer service telephone line. Calls we place from it are strictly for customer care — returning and following up on support requests you start with us. We do not make marketing, sales, promotional, or pre-recorded/autodialled "robocall" campaigns on this line.
14.1 When we call you, and your consent
We call you only when you already have a relationship with Rubyy and have given us a number for support — for example, you call our service line and leave a callback number, you open a support request tied to your account or order, or you ask us to call you back. Outbound calls are limited to that customer-initiated matter. Calls are placed through our telephony provider, Twilio, and may display "Rubyy" as a verified caller name (branded calling) so you can recognise that the call is from us.
14.2 Opting out of calls
Ask us to stop calling during any call, or email [email protected], and we will honour your do-not-call request immediately. Opting out of calls does not change your SMS preferences (see § 4) or essential written notices about your account, such as receipts and security alerts.
